Terms and Conditions for Rentlyhood

Thank you for joining the RentlyHood community. Your use of our app/ website - https://rentlyhood .com website (the "Service") is governed by these Terms of Service (the "Agreement"). By using the Service, you agree to be bound by, and use the Service in compliance with, these Terms of Service. If you do not agree to these terms of service, do not use the service.

The terms "you," "your," and "yours" refer to you, the user of the Service. The terms "RENTLYHOOD," "we," "us," and "our" refer to Rentlyhood. This Agreement exists solely between you and RENTLYHOOD. We may periodically make changes to this Agreement. It is your responsibility to review the most recent version of these Terms of Service frequently and remain informed of any changes to it. You agree that your continued use of the service after such changes have been published to the service shall constitute your acceptance of such revised terms of service.


Nature of the Service

The Service allows users to rent from, and lend goods ("Loaned Items") to other users. Use of the Service may require a compatible mobile device/laptop and/or access to a data network. Third party data use fees may apply.


How renting works

  • Users register for the Service and find an item for rent listed by an Owner/lender.
  • The Rentee may then request to rent the item from the Owner/Lender for a specified time period, mentioned pick-up location and calculated price shown on the app.
  • Based upon the requested date, Lender may approve or reject rentee’s request. Once approved, rentee and lender may use in-app chat to further align/agree on any other details.
  • Rentee would then proceed ahead with the payment on the app.
  • On rental start date, rentee should pick-up items from Lender from the mentioned pick-up location. Unless otherwise agreed by Owner/lender and Rentee in writing via in-app chat, all rented items are to be picked up and returned during the rental period specified on the website/app.

All rented items must be returned at or before the time scheduled. Failure to return a rented item in a timely manner shall be a violation of these Terms of Service and shall result in the imposition of a late fee. Repeated or prolonged failure to return a rented item or items in a timely manner, in addition to grounds for the imposition of late fees, shall be a violation of these Terms of Service, grounds for termination of the user’s account, and may be reported to law enforcement as possible theft.


Late fee Charges

Rentals returned late as per the schedule on the site, or after the previously agreed upon time to return the item, are subject to a late fee as follows (unless agreed with lender in written via in-app chat):

  • Items returned late up to 2 hours* but same day as due: 20% of the daily rental charge
  • Items returned late by more than 2 hours* but same day as due: 100% of the daily rental charge
  • Items returned late and not on the same day as due: 110% of the daily rental charge per day

*Hours calculations follow the 24 hour principle from the time of pick-up. For example, If Rentee has picked-up an item on 21st March 10:00 AM for 2 days then the item has to returned by 23rd March 10:00 AM

Damage Charges

As a Rentee ("person who has taken item on rent from Lender") of a rented Item, you are responsible for returning the rented Item in the condition it was in when you obtained it (less normal wear and tear). You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you permit to use or otherwise access the Loaned Item.

(a) For Rentee: As a Rentee you are responsible for any damage caused to the loaned item arising out of accidental, misuse or abuse of the equipment or intentional damage.

(b) Claims against Borrower by Owner: If the owner ("Owner") of a Loaned/rented Item claims and provides evidence that you as a Borrower have damaged a Loaned/rented Item (a "Damage Claim"), the Owner may assert a Damage Claim with Rentlyhood. If an Owner makes a Damage Claim to Rentlyhood, the Borrower/rentee will be provided a reasonable opportunity to respond. Rentlyhood will decide as to whether the damage alleged in the Damage Claim was caused by Borrower/rentee. Rentlyhood’s determination shall be final and binding as between Owner/lender and Borrower/Rentee with respect to any Damage Claim. Such determination relates to damages to the Borrowed/rented Item only, and not to any other alleged damages, including any damages to property, or third parties.

If Rentlyhood determines a Borrower/rentee is responsible for the Damage Claim, Borrower/rentee agrees to pay such amounts to Lender via Rentlyhood only. In the event Borrower/rentee fails to pay on a Damage Claim within ten (10) days of Rentlyhood decision on a Damage Claim, Rentlyhood will seek reimbursement from Borrower/Rentee to the extent Rentlyhood or its insurer (if any) pays out on a Damage Claim. RentlyHood is not an insurance company, broker, or agent. Rentlyhood is not an insurance provider, broker, or agent. Rentlyhood is not licensed in any state or country to be an insurance provider, broker, or agent.


Condition of equipment

It is understood Rentlyhood is a peer-to-peer equipment/Item sharing application/website, which allows individuals to “Rent” certain equipment/item to others through Rentlyhood portal/site. Some of the equipment/item may be inherently dangerous, even when used properly. Rentlyhood is not responsible for verifying the condition of any equipment offered on Rentlyhood platform.

Rentlyhood Not liable for malfunctions in items rented via Rentlyhood

Rentlyhood is not liable for equipment malfunctions or accidents or injuries caused by use of any equipment obtained through Rentlyhood’s platform. Borrower/rentee is solely and fully responsible for the safe operation of any Equipment/item obtained through Rentlyhood’s platform. Borrower/rentee understands Equipment/item may malfunction and even properly maintained Equipment/item and such malfunction may cause injury or harm.

Borrower/Rentee acknowledges they intend to use Equipment/item obtained through Rentlyhood’s platform, which may be inherently dangerous. Borrower/rentee acknowledges that they have been advised to read and review all safety precautions and instructions for any specific Equipment before using the Equipment.

Borrower/rentee is responsible for ensuring that they are comfortable with using the Equipment safely and competent to operate the Equipment safely.

Borrower/rentee hereby expressly assumes all risks associated with use of any Equipment obtained through Rentlyhood’s platform, website, or mobile application. Borrower/Rentee acknowledges Equipment available on Rentlyhood’s platform may be inherently dangerous, even if used properly.

Borrower/Rentee agrees use of Equipment involves many obvious and not-so-obvious risks, dangers, and hazards, which may result in property damage, injury or death, and such risks cannot always be predicted or avoided.


Taxes

Rentlyhood does not collect any sales or use taxes for transactions booked through RENTLYHOOD’s platform. Owners/lenders and borrowers/rentee are responsible for pay all taxes, whether local, state, or federal, which may be due as a result of the use of Rentlyhood’s platform, and any payments made or received.


Service Fees

RentlyHood charges a service fee for use of its platform. Information on the service fees and how those fees are calculated can be found here:

Rentee Service Fees

There is no service fee to rent items from others on Rentlyhood. Plus, you can reach out to our customer service for free, if you have any questions before or after your rentals.

Lender Service Fees

Only once you have a successful rental, Rentlyhood charges you - (1 euro + 15% of rental amount) as service fee. This will come directly out of your rental. Our service fee helps us run our platform and connect more people from the community for awesome experiences. This covers you for any queries that you may have for your rentals with our 24/7 customer service.


Cancellation of a Rental

Rentlyhood charges a cancellation fee for late cancellations. Information on the cancellation fees can be found here:

  • If a Rentee cancels more than 48 hours prior to reservation, there is a full refund except for service fees incurred by Lender for this rental.
  • If a Rentee cancels less than 48 hours ahead of the rental period, they will be charged 50% of the rental fee.
  • If a Rentee cancels within 24 hours before the rental period, there is no refund.

If the owner agrees to cancel due to rain or some other circumstance, then it has to be agreed in writing via in-app chat and there is no cancellation fee. There will be a full refund except for service fees.


Lenders – responsible for maintenance

All owners are required by Rentlyhood to verify any loaned equipment listed on Rentlyhood’s platform has been properly maintained, and does not include any known material defects. Rentlyhood does not perform any independent testing or physical examination of equipment which lenders are offering on Rentlyhood’s platform. Borrower’s/rentees use of any equipment/item, through Rentlyhood’s platform is at borrower’s own risk.

Before each use of any Equipment, Borrower/rentee is responsible for conducting a basic safety inspection of the Equipment. Borrower/rentee agrees not to use the Equipment if there are any noticeable defects or safety concerns, and to immediately notify Rentlyhood support of any problems.

If at any time, whether prior to, during, or after riding any Equipment, Borrower/rentee discovers any defect or notice any other potentially unsafe condition on any Product, no matter how slight, Borrower/rentee shall not use the Equipment.


Lender – indentification of host

Borrower/Rentee agrees to defend, indemnify, and hold harmless Rentlyhood and Lender from and against any and all consequences, claims, demands, causes of action, losses, liabilities, damages, injuries, fees, costs and expenses, penalties, attorneys’ fees, judgments, suits settlements, and/or disbursements of any kind, or nature whatsoever, whether foreseeable or unforeseeable, and whether known or unknown, that directly or indirectly arise from or are related to any claim, suit, action, demand, or proceeding made or brought against any Rentlyhood or Lender, or on account of the investigation, defense, or settlement thereof, arising out of or in connection with, whether occurring heretofore or hereafter: (i) Your use or misuse of Equipment, (ii) Your breach or alleged breach of this Agreement; (iii) Your violation or alleged violation of any laws, rules, regulations, codes, statutes, ordinances, or orders of any governmental or quasi-governmental authorities in connection with any Equipment; and (iv) any misrepresentation made by Borrower/rentee (all of the foregoing, “Claims and Losses”).

Borrower/rentee will cooperate in the defense of any of the foregoing. Notwithstanding the foregoing, Rentlyhood retains the exclusive right to settle, compromise, and pay any and all Claims and Losses.


Prohibited Items and prohibited activities

The following categories of items, included but not limited to, may not be listed on Rentlyhood’s platform and any attempt to do so is a violation of these Terms of Service and may result in a user being banned. Rentlyhood has the final authority on approving the items to be available for rent on the platform.

  • Guns
  • Knives
  • Weapons of any nature
  • Bows, including hunting bows and crossbows
  • Fireworks or devices involving explosives
  • Toxic or hazardous substances
  • Illegal drugs, medications, or alcohol
  • Perishable food items
  • Renting people, living beings, or any form of human or animal trafficking is strictly prohibited on this platform. Any attempts to engage in such activities will result in immediate termination of your account and may be subject to legal action.

Rentlyhood Guarantee

Rentlyhood is essentially a sharing platform where mutual trust between neighbors is important. We therefore always advise neighbors to make good agreements with each other via our in-app chat. If something goes wrong despite all the good intentions, we have the Rentlyhood guarantee. This guarantee is there to ensure that renting out and lending out items can be done safely and without any worries. For the owner of the product, there is always a Rentlyhood guarantee when renting out and lending items. The Rentlyhood guarantee applies to borrowers if there is no intent or negligence. The warranty protects against damage, loss and theft, up to a maximum amount of €1,000.

To qualify for the Rentlyhood Guarantee, you must meet these requirements:
  • you have an existing Rentlyhood account (so your account has not been deleted);
  • you are 18 years or older;
  • you made the appointment via the Rentlyhood chat and processed the payment via Rentlyhood
  • the products that need to be repaired or replaced are described in your advertisement or the agreement with your neighbour. So make sure you name all the items when you make the appointment via the Rentlyhood chat. For example: if you lend a game console with two controllers to your neighbor, but your advertisement says it is one, name that extra controller in the chat;
  • check the items together when returning them and report damage no later than 48 hours after the end of the rental or loan. Take photos of the damage and a description and email it to “contact@rentlyhood.com”; and
  • Is your product insured or do you still have a warranty with the store? Then you should first appeal to them for the same.
The following items are not eligible for the Rentlyhood guarantee:
  • All damage, theft or other costs with regard to items that have not been lent or rented through Rentlyhood;
  • everything that does not fall under the heading of consumer products, so no food, leftover paint, plants, etc;
  • vans, passenger cars, motorcycles and other motorized means of transport;
  • property;
  • clothing cleaning costs;
  • foodstuffs; and
  • drugs, weapons and other illegal products.
The following situations are excluded from the Rentlyhood guarantee
  • lost income: (rental) income that you miss out on due to damage or loss of your product;
  • cosmetic damage: we can only pay out the guarantee in case of such damage that it impedes the function of the object;
  • cleaning costs: it is not the intention to return items dirty, but Rentlyhood has no responsibility to pay for any cleaning costs or for a replacement product;
  • damage or theft outside the rental or loan period; and
  • if the rental has not been paid for in advance via the Rentlyhood payment function.
  • In the event of damage caused by intent or negligence, theft by the hirer/borrower, and/or other fraud or acting in bad faith, Rentlyhood reserves the right to recover the damage and/or replacement from the hirer/borrower.

We will review the damage and let you know whether or not it qualifies for the Rentlyhood warranty. In some cases we may ask you for additional information. Does your application for guarantee not comply with the rules or is there a suspicion of fraud? Then Rentlyhood reserves the right not to apply the warranty or only partially. If your report is in good faith and complies with the rules, you can in most cases assume that the guarantee will be granted.

If you qualify for the Rentlyhood guarantee, we will refund you an amount. Transfer the outstanding claim you have against your neighbor to us so that we can follow up on it.

To be able to pay out the warranty, we need two more things from you:
  • a copy of the receipt and bank statement that shows us that you have purchased a replacement product or the cost of the repair;
  • you verify your personal details by providing us with a copy of your passport/ID/driving license.

After the above has been done, we will transfer it to you as soon as possible.

Tips to prevent accidents:

Prevention is better than cure. Therefore, here are some tips that can help prevent damage:

  • Ask and explain how to use the product. In most cases damage is not caused intentionally, but due to unintentionally incorrect use of a product
  • Treat someone else's belongings as you would your own
  • Make clear agreements about what you expect from each other via Rentlyhood in-app chat
  • Before and after the rental, take good quality pictures of the item so that you have proof of the items rented, in case of any dispute
  • Sharing is based on mutual reasonableness , trust and respect

For All Users

Users agree to cooperate with and assist Rentlyhood in good faith, and to provide Rentlyhood with such information and take such actions as may be reasonably requested by rentlyhood, in connection with any Damage Claims or other complaints or claims made by users relating to their borrowing experience via the Service. A user shall, upon Rentlyhood's reasonable request and at no cost to the user, participate in mediation or a similar resolution process with another user, which process will be conducted by rentlyhood or a third party selected by Rentlyhood or its insurer, with respect to losses for which a user is requesting payment from Rentlyhood. In the event a Borrower/Renter damages or destroys a Loaned/rented Item, Rentlyhood, in its sole discretion, will have the final authority to settle the dispute.


Violations and Disclosure of Information.

Rentlyhood reserves the right to investigate, prosecute, litigate, or refer to law enforcement, any violations of its Terms of Use to the fullest extent permissible by applicable law. Rentlyhood may access and disclose your information if we are permitted or required to do so by law under the following circumstances: (1) it is necessary to respond to claims asserted against RENTLYHOOD; (2) to comply with legal process (for example, subpoenas or warrants); (3) to enforce or administer these Terms of Use; (4) to prevent fraud; or (5) for such other lawful purpose as may be required.

Rentlyhood reserves the right to remove or disable access to any content Rentlyhood, at its sole discretion, considers objectionable for any reason. Rentlyhood is not required to provide advance notice to a user of such action. In the event of a violation of our Terms of Use, Rentlyhood may limit, suspend, or terminate your account and access to our services, remove hosted content, deny a claim for coverage, remove, and demote your listings, reduce, or eliminate any discounts, and take technical and/or legal steps to prevent you from using our Services.


Refer and Earn Program

Eligibility:

The program is open to all existing users of Rentlyhood who have an active account in good standing. Referrals can only be made to individuals who are not existing users of Rentlyhood.

Referral Process:

To participate, users must share their unique referral code or referral link provided by Rentlyhood. Referrals must sign up using the referral code or link to be considered valid.

Incentives:

Both the referrer and the referred user are eligible for incentives. Incentives may include credits, discounts, or other rewards as determined by Rentlyhood. The exact nature and value of incentives will be specified in the ‘Reward Qualification and program details’ below.

Reward Qualification and program details:

To qualify for rewards, the referred user must successfully sign up on the Rentlyhood app using the referral code of the referrer. Rewards will be provided to eligible referrers and referred users within 7 days from the date of successful sign-up in form of rentlyhood points. The points will be credited to each user's Rentlyhood wallet, which can be used within the app itself.

Fraudulent Activity:

Rentlyhood reserves the right to disqualify referrals or revoke incentives if fraudulent activity, including but not limited to fake accounts, spamming, or misuse of referral codes, is detected.

Any violation of the referral program terms and conditions may result in the termination of the user's account.

Program Changes

Rentlyhood reserves the right to modify or terminate the referral program at any time without prior notice. Changes to the program, including incentives, eligibility criteria, and referral process, will be communicated to users via Rentlyhood’s website.

Limitations:

The number of referrals per user may be subject to limitations, as determined by Rentlyhood. Referrals cannot be retroactively applied to accounts that were created prior to the launch of the referral program.

Compliance with Terms of Service:

Users participating in the referral program must comply with Rentlyhood's Terms of Service and any other applicable policies.


Rentlyhood Student Ambassador Program

The Rentlyhood Student Ambassador Program is designed to engage and empower passionate individuals to promote our platform, build a community, and earn valuable rewards. Please carefully read and understand the following terms and conditions before applying:

Eligibility:

To participate in the program, you must be a currently enrolled student in Ireland and at least 18 years old.

Application Process:

To apply, fill out the application form available on our website or send us an email to contact@rentlyhood.com. Successful candidates will be selected based on their application and an interview (if required).

Program Duration:

The Rentlyhood Student Ambassador Program is an ongoing initiative with a semester-wise evaluation. Ambassadors can continue their role as long as they meet the program's performance criteria.

Roles and Responsibilities:

Ambassadors will actively promote Rentlyhood through various marketing activities, both online and offline.Responsibilities may include social media engagement, organizing events, and referring users to the platform. Ambassadors must maintain professionalism and adhere to our brand guidelines.

Incentives and Rewards

Ambassadors earn points for completing program activities. Points can be redeemed for discounts on Rentlyhood services. Top-performing ambassadors may receive additional rewards and recognition. Monthly goals can earn you gift vouchers from partner companies, like Tesco, Amazon, Dunnes, etc.

Communication:

Ambassadors will engage in regular communication with the Rentlyhood team and fellow ambassadors.

Non-Disclosure Agreement:

Ambassadors must maintain the confidentiality of program details and any sensitive information shared by Rentlyhood.

Termination:

Rentlyhood reserves the right to terminate an ambassador's participation in the program if they violate terms and conditions.

Agreement

By applying to the Rentlyhood Student Ambassador Program, you acknowledge and accept the terms and conditions.

Changes to Terms:

Rentlyhood reserves the right to make changes to these terms and conditions. Ambassadors will be notified of any modifications.

Rentlyhood Wallet

Point Accumulation:

Users can accumulate points in their Rentlyhood wallet by participating in various promotions, including referrals, completed rentals, and other activities as communicated on our social media handles from time to time.The number of points earned per activity may vary depending on ongoing promotions.

Point Conversion:

Every 100 points accumulated in the wallet are equivalent to 1 euro in-app credits.

Coupon Generation:

Users who have accumulated 500 or more points can generate a 5 euro worth coupon by clicking the "Redeem Now" button in their wallet. Each coupon generated will have a fixed value of 5 euro in-app credit. Users can generate a maximum of 5 coupons in a single click by clicking the "Redeem Now” button. If the user has more than 2500 points, they can generate additional coupons by clicking the “Redeem Now” button again.

Coupon Redemption:

Each coupon generated will have a limited validity and a minimum order value requirement. The validity period and minimum order value will be mentioned on the generated coupons.
Users can view all existing valid coupons at the time of payment for a rental booking. Only one coupon can be used per order.

Coupon and Point Ownership:

Coupons generated through the wallet program are non-transferable and can only be used by the user who earned them. Points earned by users cannot be transferred or gifted to other users. All coupons and points are only valid for individual user who has earned them and cannot be shared, sold, or transferred to any other users. This policy ensures fair and transparent use of coupons and points within the Rentlyhood platform.

General Terms:

Rentlyhood reserves the right to modify, suspend, or terminate the wallet program, coupons, and their terms and conditions at any time.


Theft/Repairs

All claims of theft require:

  • A copy of a filed police report;
  • Confirmation of the police report filing and a criminal investigation by law enforcement;
  • Any information or footage that can help provide details of the theft for RENTLYHOOD’s investigation of the claim.

RENTLYHOOD may contact law enforcement and report a borrowed item as stolen where:

The following conduct may result in the reporting of the item you have borrowed as stolen to law enforcement:

  • If you fail to return the item, you booked at the time and place agreed upon with the host and/or designated in your reservation;
  • If you do not return the item by the end of the reservation period and you have not properly obtained an extension of the reservation through the RENTLYHOOD system as set forth here;
  • If the item is returned to any place other than the return location on the reservation or agreed upon with the owner. Any damage to, or loss or theft of, an item occurring prior to the host inspecting the item upon return at the end of the reservation is the guest’s responsibility;
  • If you misrepresent facts to the host pertaining to booking, use, or operation of an item.
  • If you fail or refuse to communicate in “good faith” with the Lender, police, RENTLYHOOD, or other authorities with a full and honest report of any accident or vandalism involving a borrowed item or otherwise fails to cooperate in the investigation of any accident or vandalism;
  • If the borrowed item is used or operated by anyone who has provided a fake or fictitious name, or incorrect address; or who misrepresents or withholds facts to/from the Lender or RENTLYHOOD material to the booking, use or operation of equipment.

If RENTLYHOOD reports an item as stolen, you are possibly subjecting yourself to arrest, civil and/or criminal penalties, and voiding of your coverage and/or protection plan


Missing Equipment

In the event any equipment you book through RENTLYHOOD’s services, which goes missing or is stolen, you must immediately contact the Lender and file a police report within 24 hours. You must also cooperate fully with the Lender, law enforcement, RENTLYHOOD, and other authorities in all matters related to any associated investigation.


RENTLYHOOD’s Role

RENTLYHOOD’s responsibilities are limited to:

(i) facilitating the availability of the platform; and (ii) serving as the limited payment collection agent of each Owner or Borrower for the purpose of accepting payments from the Borrower or third-party cardholder and/or bank account holder on behalf of the Owner, while assessing any applicable rental fees, transaction fees, rental cancellation fees, late rental drop-off fees, or other charges or costs associated with the transaction


Access and Modifications to the Service

We do not provide you with the equipment to access the Service. You are responsible for all fees charged by third parties to access the Service (e.g., charges by mobile device service providers). We reserve the right to modify or discontinue, temporarily or permanently, all or a part of the Service without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

We also reserve the right, in our sole discretion, to reject, refuse to post, or remove any posting by you, or to restrict, suspend, or terminate your access to the Service at any time, for any or no reason, with or without prior notice, and without liability. You must be a resident of Ireland to register as a user or to use the Service.

Registration: To access certain features of the Services, you must sign up for an account with us (a “RENTLYHOOD Account”) by providing your first name, last name, email address, and creating a password. All information must be accurate and current. Where permitted, RENTLYHOOD has the right, but not the obligation, to undertake screenings, checks, and processes designed to help verify or check the identities and/or backgrounds of users and items. If you provide false or incorrect information, RENTLYHOOD reserves the right to suspend or terminate your account.


Communications

By registering an account with RENTLYHOOD, you consent to receive digital communications from RENTLYHOOD. These communications may include notices about your account and are part of your relationship with us. We may also send you promotional communications via email, including, but not limited to, newsletters, special offers, surveys and other news and information we think will be of interest to you. You may opt out of receiving these promotional emails at any time by following the unsubscribe instructions provided therein.


Payments

Payments for Loaned/rented Items obtained through our Service are provided by our third-party payment processor, Stripe. Please see Stripe's Services Agreement for any questions about payment processing. By providing a credit or debit card, you represent and warrant that you are authorized to use the designated payment method and that you authorize or our third-party payment processor to charge your payment method for the total amount of your Loaned Item (including any applicable taxes and other charges) (collectively, as applicable, an "Order"). If the payment method cannot be verified, is invalid or is otherwise not acceptable, your Order may be suspended or canceled.


Restrictions

You must comply with all applicable laws when using the Service. Except as may be expressly permitted by applicable law or authorized by us in writing, you will not, and will not permit anyone else to: (a) store, copy, modify, distribute, or resell any of the information; audio, visual, and audiovisual works; or other content made available by RENTLYHOOD or its users on the Service ("Content") or compile or collect any Content as part of a database or other work; (b) use any automated tool (e.g., robots, spiders) to use the Service or store, copy, modify, distribute, or resell any Content; (c) rent, lease, or sublicense your access to the Service to another person; (d) use the Service or Content for any purpose except for your own use; (e) circumvent or disable any digital rights management, usage rules, or other security features of the Service; (f) use the Service in a manner that threatens the integrity, performance, or availability of the Service; or (g) remove, alter, or obscure any proprietary notices (including copyright notices) on any portion of the Service or Content.

The Service allows you and other third parties to post information to the Service. Any opinions, advice, statements, services, offers, or other information that constitutes part of the content expressed or made available by third parties on the Service are those of the respective authors or producers and not of RENTLYHOOD, or its officers, directors, or employees.

You agree that RENTLYHOOD is free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you may send to us (each, a "Submission"), without further compensation, acknowledgement, or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the Service and our products and services. Furthermore, by posting any Submission on the Service, submitting information to us, or in responding to questionnaires, you grant us a perpetual, non-exclusive, fully paid, royalty-free, irrevocable, sublicensable, worldwide license and right to display, use, perform, reproduce, modify, distribute, and create derivative works of the Submission or information submitted in any media, software, or technology of any kind now existing or developed in the future. By posting or providing a Submission or information, you represent and warrant that: (i) you own all right title and interest in your Submissions or otherwise have the right to grant the license set forth herein, and (ii) the posting of your Submissions on or through the Service does not (and will not) violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay all royalties, license fees and any other monies owing any person by reason of any Submission posted by you on or through the Service.

You will not use the Service to: (a) upload, post, email, or otherwise transmit any information that contains personally identifying information, unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; (b) harm RENTLYHOOD or third parties in any way; (c) impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity; (d) upload, post, email, or otherwise transmit any information that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); (e) upload, post, email or otherwise transmit any information that infringes any patent, trademark, trade secret, copyright or other proprietary right of any party; (f) upload, post, email, or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other forms of solicitation; (g) upload, post, email, or otherwise transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment; (h) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; (i) intentionally or unintentionally violate any applicable local, state, national or international law or regulation; (j) "stalk" or otherwise harass another; (k) collect or store personal data about other users.

Limitation on Damage Claims Against RENTLYHOOD

By agreeing to these Terms of Service, users of the RENTLYHOOD platform expressly agree they will not be entitled, under any circumstances, to an award of incidental or consequential damages, including but not limited to lost profits, for any claims asserted against RENTLYHOOD, whether arising in contract, tort, common law, statute, or regulation.


Disclaimer of Warranties

Rentlyhood does not assume liability for loaned/rented items. Rentlyhood does not screen borrowers/renters, owners/lenders, or their loaned/rented items. You are solely responsible for the proper use of any loaned/rented item you procure from the service.

Your use of the service and content is at your sole risk. The service and content are provided on an "as is" and "as available" basis. Rentlyhood expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee the accuracy, completeness, or usefulness of the service and content, and you rely on the service and content at your own risk. Any material obtained through the service is done at your own discretion and risk and you will be solely responsible for any damage to your computer or loss of data that results from the download of any material through the service. No advice or information, whether oral or written, obtained by you from rentlyhood or through or from the service will create any warranty not expressly stated in this agreement. Rentlyhood makes no warranties with respect to aspects of the service provided by third parties. We make no warranty regarding any transactions executed through, or in connection with the service, and you understand and agree that such transactions are conducted entirely at your own risk. Any warranty that is provided in connection with any loaned items, services, products, materials, or information available on or through this site from a third party is provided solely by such third party, and not by us or any other of our affiliates.


Indemnity

You will indemnify and hold RENTLYHOOD, and its subsidiaries, affiliates, officers, agents, and employees (the "Indemnified Parties''), harmless from any costs, damages, expenses, and liability caused by your use of the Service, Content, Loaned Items, your violation of this Agreement, or your violation of any rights of a third party through use of the Service, Content, or Loaned Items. For the sake of clarity, this indemnity will cover any claims against the Indemnified Parties arising in connection with personal injury or death occurring in connection with the use of, or exposure to, Loaned Items by you or your representatives (e.g., your spouse or family members) or received by you or your representatives (e.g., members of your family, caregivers, your children, or other children under your care).


GDPR Clause for Rentlyhood Mobile Application:

Data Collection:

By using the Rentlyhood mobile application, you consent to the collection and processing of your personal data in accordance with the General Data Protection Regulation (GDPR). We may collect and process personal data, including but not limited to your name, email address, contact information, and location, for the purpose of providing the services offered by the application.

Purpose of Data Processing:

The personal data collected from you will be used for the purpose of facilitating the platform services, including but not limited to managing bookings, processing payments, and communicating with you about your rental reservations. Your personal data may also be used for internal analytics and marketing purposes, to improve our services and provide you with a better user experience.

The legal basis for processing your personal data is your explicit consent, as provided when you use the Rentlyhood mobile application. You have the right to withdraw your consent at any time by contacting us using the contact information provided in this application.
